Alberta Health Services Seeks to Recover $49 Million for Undelivered Medication

Premier Danielle Smith has announced that Alberta Health Services is taking legal action to reclaim $49 million paid to a Turkish pharmaceutical company and an importer for medication that was never received.

This payment is part of a second agreement, following an initial deal that did result in some medication being delivered.

The initial agreement to purchase five million bottles of children's painkillers in 2022, during a nationwide shortage, is under investigation by the RCMP and the auditor general.

At a recent news conference, Premier Smith stated that AHS is pursuing legal avenues to recover the funds, abandoning its previous plan to obtain alternative painkillers with the already paid money.

Smith noted that the contract in question was poorly written, leading to changes in the strategic procurement process to ensure standardization.

The Premier expects AHS to exercise greater caution when signing contracts in the future.

When questioned about the delay in seeking legal action, Smith did not provide a direct answer, nor did she comment on whether other suppliers have similar leeway in delivering products.

A retired Manitoba judge, appointed by the United Conservative government to investigate allegations of contracting irregularities, found that AHS did not follow proper procedures in the medication purchase.

The judge's report also revealed that a key employee had a conflict of interest, having worked for both AHS and MHCare, a medical supply firm.

It was found that the former health minister, Jason Copping, ordered AHS to purchase the medication before obtaining approval from Health Canada.

A follow-up report by forensic accountants revealed that AHS renegotiated the deal for a different drug at a higher price in July 2023, after Health Canada refused to allow the importation of most of the originally ordered medication.

Despite the renegotiation, no medication was delivered due to federal regulatory hurdles.

MHCare's lawyer, Scott Hutchison, stated that a contract is in place, and its terms were negotiated and approved by AHS at the highest levels.

Hutchison expressed confidence that MHCare would fulfill the contract terms, citing ongoing communication with Health Canada and the frustration of lengthy regulatory approvals.

Minister Matt Jones stated that AHS is working through a legal dispute resolution process and may turn to the courts if necessary to recover the $49 million.

Jones emphasized the expectation that the full amount would be recovered, given that the products were not delivered as ordered.

When asked about potential future payments to MHCare or the Turkish pharmaceutical firm, Jones declined to comment.

The original contract did not specify the amount of money allocated to each company, as noted in the judge's report.

Jones described the incident as an unfortunate example of poor contracting and procurement, and acknowledged the government's commitment to implementing the judge's 18 recommendations.

Opposition Leader Naheed Nenshi welcomed the Premier's acknowledgment of the poor deal but criticized the attempt to shift blame.

Nenshi argued that the government had been careless with public funds, citing the significant amount of $50 million, which could have been used to hire triage physicians.

The former CEO of AHS, Athana Mentzelopoulos, is suing her former employer and a cabinet minister for wrongful dismissal, alleging she was fired for investigating concerns about AHS contracts, including the children's medication contract.

Mentzelopoulos's allegations have not been tested in court, with her former employers claiming she was not fulfilling her duties.

The situation highlights the need for greater transparency and accountability in government procurement processes.

The ongoing investigation and potential legal action will likely shed more light on the circumstances surrounding the undelivered medication and the use of public funds.

As the government works to recover the lost funds, it must also address the systemic issues that led to this situation.
