Prosecutors Explain Why They Won’t Seek the Death Penalty for Nick Reiner

Los Angeles County District Attorney Nathan Hochman told reporters that if Nick Reiner is convicted, the harshest punishment he could receive is life in prison without the possibility of parole.

Reiner, 33, the son of filmmaker Rob Reiner, was charged on Dec. 16 with first‑degree murder after he allegedly stabbed his parents while lying in wait at their Los Angeles home late last year.

Before making the decision, Hochman’s office conducted a thorough review, speaking with the victims’ family and weighing mitigating factors. Deputy Public Defender Kimberly Greene highlighted Reiner’s serious mental illness and long history of self‑medication as key considerations.

California has not carried out an execution in more than twenty years, and Governor Gavin Newsom placed a moratorium on the death penalty in 2019. The state’s long‑standing pause influences how prosecutors approach capital cases.

Although the case involved a lying‑in‑wait allegation and a knife, which normally could support a death‑penalty charge, the combination of Reiner’s mental‑health issues and the state’s moratorium led prosecutors to rule out capital punishment.

A trial is not expected until at least 2027, giving the court time to address the complex legal questions surrounding the case and the potential release of grand‑jury transcripts.
