Judge Boardman Blocks Trump’s Birthright Citizenship Order: A Constitutional Check
In a 35‑page ruling, Boardman wrote that the order is “likely unconstitutional” because the Supreme Court’s June decision in Barbara v. Trump already confirmed that children born on U.S. soil are citizens at birth under the 14th Amendment.
Boardman added that the order would cause irreparable harm to children and families, noting that even a temporary denial of citizenship could leave permanent scars and that the order conflicts with the established interpretation of the 14th Amendment.
The White House reacted by calling Boardman an “activist judge” appointed by President Biden who is trying to thwart the President’s “commonsense agenda.”
The lawsuit was filed by Court Appointed Special Advocates (CASA). Among the plaintiffs are Andrea, who fled a Mexican region controlled by a cartel, and Monica, a Venezuelan woman who fears her family could be wrongly linked to a terrorist organization, highlighting the personal impact the order could have.
