The study had been prepared for a landmark federal commission of inquiry on war crimes. For years, B'nai Brith Canada pressed for more of the report prepared by researcher Alti Rodal. In February 2024, Library and Archives Canada released additional sections after B'nai Brith filed an access‑to‑information request.
However, Library and Archives kept back passages that describe the role of American intelligence agencies in helping Nazi collaborators settle in Canada. Justice Fothergill rejected the government’s claim that publishing those details would damage Canada’s international relations, emphasizing the public’s right to know over diplomatic concerns.
The ruling shows that courts can intervene when the government tries to hide historical evidence, reinforcing transparency and accountability for past injustices. It also highlights the delicate balance between national‑security arguments and the need for public awareness of how foreign actors may have assisted war criminals.
