McRib Lawsuit Shows How Misleading Ads Can Lead to Court Battles
Vụ kiện McRib: Quảng cáo gây hiểu nhầm có thể dẫn đến kiện tụng

A U.S. federal judge has allowed a lawsuit against McDonald's to proceed, focusing on the famous McRib sandwich. The case highlights how food advertising can be examined in court.
The plaintiffs say McDonald’s deliberately shapes the McRib patty with ridges that look like pork ribs, suggesting the sandwich contains rib meat, a pricey cut. They also claim the chain uses lower‑grade pork parts such as shoulder, heart, tripe or stomach, so customers pay more for a product that is not what they expect.
U.S. District Judge April Perry noted it is premature to dismiss the argument that a reasonable consumer could expect rib meat in the sandwich. She pointed out that the McRib’s website only lists pork as an ingredient and that ads emphasizing the rib‑like shape might support an intent‑to‑defraud claim, although more proof is needed.
McDonald’s responded that it never uses hearts, tripe or stomach in the McRib and says its marketing has always been transparent about the ingredients. Plaintiffs’ lawyer Thiago Coelho said his clients will keep seeking accountability for what they call deceptive marketing.
The lawsuit shows that misleading product descriptions can lead to consumer‑fraud claims, and courts will look closely at how a product is presented in ads and on menus. Companies should ensure their marketing matches the actual ingredients to avoid legal challenges.
