Hyecorp breach highlights gaps in affordable‑housing rules for Sydney’s low‑income renters

Hyecorp, a major Sydney property developer, admitted that in early 2024 it let a staff member live in an apartment that had been set aside as “affordable” housing under its planning agreement with Willoughby City Council.

The company said the employee was experiencing “significant personal and financial challenges”, but it also confirmed that the unit was not being managed by a registered community housing provider, as required by the planning conditions.

The Willoughby development, known as Sienna apartments, is a 74‑unit complex completed in 2017. Fifty‑percent of the units – 42 apartments – were earmarked for affordable rentals for a ten‑year period that runs until 2028.

Under NSW planning rules, developers receive extra height or density bonuses only if they set aside a portion of their project for affordable housing and appoint a registered community housing provider to run those units.

The NSW government passed a 2025 bill that would make it an offence to rent affordable units without a community housing provider, describing it as a “crackdown” on misuse. However, the reforms have not yet been implemented.

Willoughby City Council has said it is “actively investigating a potential compliance issue” with the Hyecorp development, and the state government has acknowledged that the new rules are expected to be in force by the end of the year.

Experts such as University of NSW planning researcher Ryan van den Nouwelant argue that the Hyecorp case highlights the urgency of the pending reforms, especially after recent incentives that encourage developers to include affordable housing in new projects.

For low‑income renters, breaches like this can reduce the supply of genuinely affordable homes and undermine confidence that the promised protections will be upheld.
