Banff’s Federal Lease and Treaty 7 Status Make It a Flashpoint in Alberta’s Separation Debate

Since 1990 Banff has paid Ottawa $550,000 each year to lease the land on which the town sits. Residents own their houses, but the ground beneath them belongs to the federal government, which can veto most bylaw changes.
Alberta runs Banff’s hospital and schools, but the federal government retains ownership of the parkland and the power to reject municipal bylaws. This split of responsibilities creates a tangled web of authority that would have to be untangled in any separation talks.
The town sits on Treaty 7 territory, a 149‑year‑old agreement between the Crown and the Stoney Nakoda Nations. The treaty predates both Banff National Park and the province of Alberta, giving Indigenous peoples a legal stake in any future changes.
On Oct 19 Albertans will vote on whether to hold a referendum on separating from Canada. A 1998 Supreme Court decision says a province cannot secede without the agreement of the federal government, adding a national legal hurdle to the process.
A coalition of First Nations has already filed a court challenge, arguing that any move toward separation must obtain the consent of the Treaty 7 nations. The challenge could block a referendum or any subsequent secession plan.
Because Banff’s land is leased from the federal government and lies within Treaty 7, it could become a flashpoint in negotiations. Mayor Corrie DiManno has urged voters to keep Alberta in Canada, warning that the town might end up as an isolated Canadian enclave if separation proceeds.
