He says the judge made nine mistakes, including using irrelevant information.
Rath wants the appeals court to cancel the order and stop it until the appeal is decided.
The chief's lawyer says Rath's appeal has no basis and should be dismissed.
The chief will respond strongly to Rath's appeal and ask for costs.
